Belgium, Flanders: Debate intensifies over euthanasia rights for dementia patients as advocacy groups and lawmakers call for urgent legislative reforms
Belgium is facing mounting pressure to reform its euthanasia laws for people with dementia, following the emotional case of Lode Deconinck, whose final letter has reignited national debate over patient rights and medical ethics.
Deconinck, diagnosed with early-onset dementia at the age of 51, chose to undergo euthanasia in early February. His decision, however, was not solely driven by the progression of his illness, but by the limitations imposed by Belgium’s legal framework.
In a posthumous letter, Deconinck revealed he felt compelled to “say goodbye too soon” to ensure he could still qualify for euthanasia under existing laws. His words have since resonated deeply with both the public and policymakers.
“I would have liked to have lived a little longer,” he wrote, describing the painful trade-off between extending his life and losing the legal ability to decide how it would end.
Belgium legalized euthanasia in 2002, becoming one of the first countries in the world to do so. The law permits the practice for patients experiencing constant and unbearable suffering due to serious and incurable medical conditions.
However, strict safeguards remain in place. Patients must be conscious, mentally competent, and able to clearly express their wishes at the time the procedure is carried out.
For individuals with dementia, this requirement presents a significant challenge. As the disease progresses, cognitive decline can render patients unable to provide informed consent, effectively closing the window for euthanasia.
While advance directives are permitted under Belgian law, they are limited in scope. They apply only to patients who are in an irreversible state of unconsciousness, not those suffering from advanced dementia.

Deconinck’s case has brought renewed attention to what many see as a legal and ethical gap. His proposal suggested allowing a group of trusted individuals, appointed by the patient, to determine the appropriate moment for euthanasia once the disease had progressed.
Though he acknowledged that his idea was not perfect, Deconinck expressed hope that it could inspire more comprehensive solutions. His call for reform has been echoed by Alzheimer Liga Vlaanderen, a prominent advocacy group in Belgium.
In a statement following his death, the organization urged lawmakers to amend the law to allow designated representatives to carry out the wishes of dementia patients who had previously expressed a clear and voluntary desire for euthanasia.
The group emphasized the importance of repeated and well-documented consent while the patient is still mentally capable, arguing that such measures could safeguard against misuse. Political leaders have also entered the discussion, acknowledging both the urgency and the complexity of the issue.
Annelies Verlinden, Belgium’s Federal Justice Minister, described the matter as deeply complicated. Speaking on national radio, she noted that the progression of dementia can significantly alter a patient’s behavior and experience.
“This makes it difficult to predict future situations,” she explained, highlighting concerns about whether earlier wishes should always take precedence over a patient’s condition at a later stage.
Despite these challenges, Verlinden confirmed that work is underway on a policy document addressing potential reforms. Experts are expected to provide input during an upcoming seminar scheduled for April.
Meanwhile, Frank Vandenbroucke has called for swift action. During a recent parliamentary session, he urged Verlinden to present draft legislation without delay. “All the studies and expert opinions are in,” he stated, adding that there appears to be broad public support for revisiting the law.
Vandenbroucke’s remarks reflect growing political momentum behind the issue, although consensus on the exact form of reform remains elusive. The debate touches on fundamental ethical questions about autonomy, dignity, and the role of medical professionals in end-of-life care.
Supporters of reform argue that current laws unfairly force dementia patients into making premature decisions, effectively shortening their lives against their true wishes. They contend that allowing advance directives to extend into later stages of dementia would respect patient autonomy and reduce unnecessary suffering.
Opponents, however, caution against expanding euthanasia laws without robust safeguards. They raise concerns about the potential for abuse and the difficulty of interpreting a patient’s wishes once cognitive decline has set in.
Medical professionals are also divided. Some doctors support reform, believing it would provide clearer guidance and reduce moral distress when treating dementia patients. Others worry about the burden of making life-ending decisions on behalf of patients who can no longer communicate their desires.
Belgium’s experience with euthanasia has often been viewed as a model for other countries, but the current debate highlights the ongoing evolution of such policies. As life expectancy increases and the prevalence of dementia rises, the issue is likely to become even more pressing.

Deconinck’s final message underscores the human dimension of the debate, serving as both a personal farewell and a call to action. “For me, it is too late,” he wrote. “But that does not mean it is no longer worthwhile.”
