A growing debate over the use of Automatic Number Plate Recognition (ANPR) cameras in Flanders is prompting calls for stricter oversight, as residents question whether the surveillance tools are being used in compliance with privacy laws.
The controversy was reignited after Hans Graux, Chair of the Flemish Supervisory Commission (VTC), spoke on the VRT1 program De Zevende Dag on Sunday, urging citizens to take legal action if they believe their rights are being violated by local camera use.
His remarks follow a VTC ruling earlier this week against the deployment of eleven ANPR cameras in Grimbergen, installed in mid-2024 to enforce speed limits.
According to Graux, the Commission received a complaint from a local resident who claimed the cameras infringed on privacy. The VTC subsequently determined that the camera setup was non-compliant with guidelines and recommended a ban. Grimbergen has appealed the decision to the Council of State.
“This is not only about Grimbergen,” Graux stressed. “We issued a broader warning alongside our specific ruling, reminding municipalities of the need to comply with legal frameworks when using ANPR technology. Citizens who believe they are being unfairly monitored or fined by improperly used cameras have the right to contest those penalties.”
He also highlighted that the VTC has provided detailed guidance on lawful camera use, including data retention, signage, and the specific purposes for which surveillance may be permitted. Graux sees the current backlash as a timely opportunity to revisit the balance between traffic enforcement and data protection.
The growing scrutiny comes as Flemish Mobility Minister Annick De Ridder (N-VA) commissioned a study into the effectiveness and appropriateness of speed enforcement measures, including ANPR technology.
While privacy advocates welcome the VTC’s decision, local officials argue that ANPR systems are vital for road safety. Wim Dries, Mayor of Genk and Chair of the Association of Flemish Cities and Municipalities (VVSG), defended their use.
“Flanders has over 300 active speed enforcement systems. These are implemented to reduce accidents, not invade privacy,” he stated. “It’s surprising that local governments are under fire, considering that ANPR cameras are also used nationwide by judicial authorities.”
Still, the friction between enforcement and civil liberties remains a point of contention. Critics say municipalities sometimes install these cameras without adequate transparency or legal clarity, raising fears of a surveillance state under the guise of safety.
For now, the Council of State will decide whether Grimbergen can continue to operate its camera network. Meanwhile, Graux encourages all citizens who feel their privacy is being breached by local enforcement measures to seek redress.
“This is an ideal moment to have a broader conversation,” Graux concluded. “We must find a balanced approach that protects both public safety and fundamental rights.”
The outcome of the Grimbergen appeal may well set a precedent for camera usage across the region.
